Privacy Policy


The following privacy notice addendum, together with the Black Hosting Solution Group Privacy Notice (the “Privacy Notice”), is applicable to you if you purchased email marketing services from Constant Contact, a brand of The Endurance International Group, Inc. (“we,” “us” or “Endurance”). Please review the below in addition to the Privacy Notice.



In connection with your use of our products or services, we will obtain contact lists (including email addresses and other information for your subscribers) and content (including the content of your campaigns) that you provide to us in connection with such use. We acknowledge your ownership rights in such contact lists and content. We will never sell or rent your contact lists to anyone without your permission and will never use your contact lists or content for any purpose other than as described here.

If you decide to import contacts from other email accounts, we collect the username and password for the email account you wish to import your contacts from.


We obtain information that is provided by you on our public forums, including the Constant Contact Community and Constant Contact Marketplace. With your consent, we may also obtain and post testimonials or reviews for inclusion on our websites or elsewhere. Your posts may remain even after you suspend or cancel your account. Reviews and contributions to any of our public communities are considered public and non-confidential by us and are not treated as proprietary information or personal information covered by this privacy notice. To request removal of your personal information on our public forums or on the public portions of our websites, please visit the Privacy Center. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.


We will only use the username and password for any email account you import any contacts from to enable you to import such contacts


If you are working with a partner, such as a Constant Contact Solution Provider, and would like that partner to have full access to your account, including the ability to send emails on your behalf, we will provide access to just that partner upon your request or consent.


Our Anti-Spam Policy permits only permission-based email. Anyone receiving emails from us on behalf of our Users (as defined in the Privacy Policy) always has the opportunity to opt-out of email messages from such User by using the opt-out link included in the footer of the message. If you believe that you have received an unsolicited commercial email from us on behalf of any of our Users, you may report it to us at


You can review and update your Constant Contact account information, including your organizational information and email address, by logging in and then clicking on the My Settings tab. Account information, such as your username and password, can be changed by logging in and then clicking on the My Account link at the top of page. The My Account page is also where you can manage product subscriptions and billing information, such as your credit card number. If you would like to suspend or cancel your account, you can do so by contacting customer support via the Constant Contact Help Center or by telephone at (267) 603-7201 if you are located in the U.S. or (267) 603-7201 if you are located outside of the U.S. If you would like to request that we no longer use your account data or obtain further information about or access to your personal information, please visit our Privacy Center. We will respond to your request for access within 30 days.


In order for us to provide the Services to you, your personal information will be transferred to, and stored at/processed in the United States. Your personal data is also processed by staff operating outside the European Economic Area (EEA), such as in India and the Philippines, who work for us or for one of our suppliers. We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this policy.

For transfers of personal information within the Endurance corporate family, such transfer will be under the Commission’s model contracts for the transfer of personal data to third countries (i.e., the standard contractual clauses), pursuant to Decision 2004/915/EC and 2010/87/EU.

For transfers of data to third parties, such transfers will either (i) be under the Commission’s model contracts for the transfer of personal data to third countries (i.e., the standard contractual clauses), pursuant to Decision 2004/915/EC and 2010/87/EU; or (ii) rely on the EU-US Privacy Shield Framework.

Endurance’s Constant Contact participates in and has certified their compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (together, the “Frameworks”). Constant Contact is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. Constant Contact is responsible for the processing of personal data they receive under each Privacy Shield Framework, and subsequently transfer to a third party acting as an agent on behalf of Constant Contact. Constant Contact complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Constant Contact is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
